Why Should You Properly Fund a Trust?

Funding a trust is important because it places assets under the trust’s legal ownership, can help avoid a costly probate process and protects your family’s privacy. Without proper funding, even a well-drafted trust may fail to protect assets that remain outside it.

Why Funding Matters

A trust is like an empty box. Writing the trust document creates the legal framework, but putting your property, money and belongings inside of that box—known as funding the trust—is what makes it work.

When you forget to transfer your assets into the trust, those assets are left outside of its protection. If you pass away with an unfunded trust, your family may still have to go through probate court. Probate is a public, expensive and slow legal process that decides who gets your property. Creating and funding your trust ahead of time allows your loved ones to skip this stress and receive their inheritance much faster.

Keeping Your Privacy

Probate court records are open for anyone to see. This means strangers, creditors and marketers can look up what you owned and who received it.

A funded trust keeps your private business private. The transfer of property to your beneficiaries happens quietly behind closed doors, without a public record of your total wealth or family details.

When assets are clearly titled in the name of your trust, there is little room for confusion or arguments after you are gone. Everyone can see your exact wishes written down and legally secured.

Common Assets to Fund

To properly fund your trust, you must change the legal owners of your major properties. Common items to transfer include:

  • Real estate: Your home or land via a new deed.
  • Bank accounts: Checking and savings accounts moved under the trust name.
  • Investment accounts: Stocks, bonds and brokerage portfolios.
  • Ira’s and 401k’s: You should name your trust as Beneficiary. 
  • Business interests: Shares or ownership parts in a company.

Taking the time to retitle these items ensures your plan works smoothly. An unfunded trust provides no real benefit, but a funded trust gives you peace of mind and protects your family’s future.
