Dear Cassie: What are the different types of alimony that are available in New Jersey? -M.H.
Dear M.H.:
In New Jersey, alimony can fall into any of the following classifications: open durational, limited duration, rehabilitative, or reimbursement.
Open durational alimony means that the alimony does not have a fixed termination date. It will be paid until the death of the payor or the payee, the remarriage of the payee, or upon the occurrence of a substantial change in circumstances to either the payor or the payee (for example, the payor’s reasonable retirement or the cohabitation of the payee). Open durational alimony is usually only applicable in cases in which the duration of the marriage totals 20 years or more.
Limited duration alimony is alimony paid for a specific, defined term. The length of the term will depend on a variety of factors, most importantly the length of the marriage. For any marriage less than 20 years duration, the total duration of alimony shall not exceed the length of the marriage, except in exceptional circumstances.
Rehabilitative alimony is alimony paid to a spouse while that spouse obtains the training and experience needed to integrate himself or herself back into the workforce.
Reimbursement alimony reimburses one spouse for financial contributions to the education or career advancement of the other.
