I represent that I am the parent and/or legal guardian of the child and/or children (hereafter “child”), listed above who submitted an advertisement (content, classified, photos or other media) and give permission to Best Version Media, LLC (hereinafter “BVM”) to publish the submitted advertisement in their neighborhood magazine(s). I also acknowledge and agree that the magazine(s) may also be used by BVM on their website, social media sites or promotional materials. I further acknowledge that BVM does not pre-qualify or screen any responses to my child’s advertisement and I agree that I am responsible to ensure that any responders to my child’s advertisement meet whatever standards, qualifications or prerequisites that are desired. Responders may also come from individuals who live outside of the neighborhood that the publication is designed for and distributed to. I further agree to hold Best Version Media, LLC, it’s members and agents harmless as a result of any injury or claims resulting from interactions between my child and any responders or their agents to the advertisement(s). I further agree to indemnify Best Version Media, LLC, its members and agents, against any claims or judgments from third parties resulting from my child’s services.

Permission to Use Content, Copy, Images, Photographs, and/or Logos

I give permission to Best Version Media, LLC (hereinafter “BVM”) to use any content, copy, images, photographs, logos or other media (hereinafter “content”) that I/we have submitted or will submit to them and their representatives in their neighborhood publication(s). I/We further acknowledge and consent to BVM using the submitted content on its website, social media sites, and promotional materials. I/We also warrant and represent that any and all information submitted to Best Version Media, LLC, is my/our own and does not violate any rights of others. In reliance of this representation I/We agree to indemnify Best Version Media, LLC, it’s members and agents, against any claims or judgments resulting from non-original, copyrighted, patented or trademarked content, including actual attorneys’ fees and any related court costs.

By checking this box, I agree to submit content, copy, images, photographs, logos, and/or other media (“Content”) to Best Version Media, LLC (“BVM”) for publication in its neighborhood publication(s) at no cost to BVM. I grant BVM an irrevocable, royalty-free, worldwide right and permission to use, publish, display, distribute, and reproduce the Content in whole or in part, with or without alteration or modification, with or without attribution, in any format and in any or all media, versions and forms, whether now known or later invented, in all languages, in any geographic territory, in perpetuity, including without limitation all print, digital, wireless or electronic formats, and in any advertising, publicity or promotion for BVM. I agree to indemnify and hold harmless BVM from any claims or lawsuits by any third-party regarding the Content alleging, among other things, the infringement of copyright or trademark, defamation or libel, or violation of any right of publicity or privacy, including any damages and reasonable attorneys’ fees or costs associated with any claim or lawsuit against BVM related to the Content. I further acknowledge and agree that BVM is not required to use the Content and whether the Content is used in whole or part by BVM is within BVM’s sole discretion and agree that BVM has the right to publish in print or post online the submitted Content without any royalty payments or further permissions.

This Content Release (“Release”) is made between Best Version Media, LLC and Best Version Media, Canada Inc. (collectively, “BVM”), and the abovementioned party (“Contributor”).

1. BVM publishes monthly neighborhood/community magazines that are distributed in both hard copy form to specific neighborhoods and may also be published in an online digital format on the world wide web. Additionally, BVM operates a website with the domain www.BVMsports.com (www.BVMSports.ca for Canada), which is dedicated to the coverage of sports in the United States and Canada from the amateur to professional levels (the “Website”).

2. Contributor desires to submit written content and/or images (“Content”) to be used for publication by BVM.

3. “Content” as used in this Agreement, means all works conceived, authored, or developed by Contributor. Content is considered the sole and exclusive property of Contributor. Contributor retains the right to package and sell Content in any format, including electronic, print, audio or in those formats which may be later invented.

4. Contributor warrants and guarantees to BVM that the Contributor owns the rights to the Content, or the Content is original on his or her part, except for such material from copyrighted sources as is reproduced with the written permission of the copyright holder, and is in no way a violation of, or an infringement upon, any copyright belonging to any third-party.

5. Contributor agrees to indemnify and hold harmless BVM from any claims or lawsuits by any third-party regarding the Content alleging, among other things, the infringement of copyright or trademark, or defamation or libel, or violation of any right of publicity or privacy, including any damages and reasonable attorneys’ fees or costs associated with any claim or lawsuit against BVM related to the Content.

6. Contributor grants BVM an irrevocable, royalty-free, worldwide right and permission to use, publish, display, distribute, and reproduce the Content in whole or in part, with or without alteration or modification, with or without attribution, in any format and in any or all media, versions and forms, whether now known or later invented, in all languages, in any geographic territory, in perpetuity, including without limitation all print, digital, wireless or electronic formats, and in any advertising, publicity or promotion for BVM.

7. Contributor is an independent contractor of BVM, and this Agreement will not be construed to create any association, partnership, joint venture, employee, or agency relationship between Contributor and BVM for any purpose. Contributor has no authority (and shall not hold itself out as having authority) to bind BVM and shall not make any agreements or representations on BVM’s behalf without BVMs prior written consent.

8. BVM is not required to use the Content in any manner and whether the Content is used in whole or part in any BVM publication or Website(s) is within BVM’s sole discretion.

9. This Release shall be governed by the laws of the State of Wisconsin.9. This Release shall be governed by the laws of the Province of British Columbia.

10. This Release shall be valid and enforceable when Contributor signs this Release and submits Content to BVM. BVM shall not be required to sign this Release in order for it to be valid and enforceable so long as it is signed in standard form by the Contributor.

11. This Release constitutes the entire agreement between parties regarding the subject matter contained herein.

Contributor agrees to indemnify and hold harmless BVM from any claims or lawsuits by any third-party regarding the Content alleging, among other things, the infringement of copyright or trademark, or defamation or libel, or violation of any right of publicity or privacy, including any damages and reasonable attorneys’ fees or costs associated with any claim or lawsuit against BVM related to the Content.

Contributor has no authority (and shall not hold itself out as having authority) to bind BVM and shall not make any agreements or representations on BVM’s behalf without BVMs prior written consent.

8. BVM is not required to use the Content in any manner and whether the Content is used in whole or part in any BVM publication or Website(s) is within BVM’s sole discretion.

9. This Release shall be governed by the laws of the State of Wisconsin.9. This Release shall be governed by the laws of the Province of British Columbia.

I/We grant permission to Best Version Media, LLC and Best Version Media, Canada Inc. (collectively, “BVM”) to use any photographs taken of me/us, my/our family members, or others, and print any information that we submit for a written article, for publication in the neighborhood magazine selected above.

I/We further provide consent for BVM to use the photographs and any information that we submit for a written article in any magazine owned by BVM, on any website controlled by BVM, on any BVM social media sites, and/or for promotional materials, including online content. We understand that BVM will make every effort to send us a copy of any article to proof before it is published. However, while our input will be considered, BVM will ultimately have editorial discretion regarding the final version of the article and/or selection of photographs to be published.

BVM will not be required to sign this agreement to indicate its agreement to be bound to the terms contained herein. Consent for use of photographs or content regarding minor children must be granted by a parent or legal guardian having authority to do so. By signing, I/We confirm that we possess the legal authority and capacity to act as the authorized representative for the minor child or children involved. By granting consent for use of photographs and/or content regarding minor children, the parent or legal guardian warrants and represents that they have authority to give consent on behalf of the minor child(ren) and that dual consent or consent of another parent or legal guardian is not required.

BVM publishes monthly neighborhood/community magazines that are distributed in both hard copy form to specific neighborhoods and may also be published in an online digital format on the world wide web. Additionally, BVM operates a website with the domain www.BVMsports.com (www.BVMSports.ca for Canada), which is dedicated to the coverage of sports in the United States and Canada from the amateur to professional levels (the “Website”).

2. Contributor desires to submit written content and/or images (“Content”) to be used for publication by BVM.

3. “Content” as used in this Agreement, means all works conceived, authored, or developed by Contributor. Content is considered the sole and exclusive property of Contributor. Contributor retains the right to package and sell Content in any format, including electronic, print, audio or in those formats which may be later invented.

4. Contributor warrants and guarantees to BVM that the Contributor owns the rights to the Content, or the Content is original on his or her part, except for such material from copyrighted sources as is reproduced with the written permission of the copyright holder, and is in no way a violation of, or an infringement upon, any copyright belonging to any third-party.

5. Contributor agrees to indemnify and hold harmless BVM from any claims or lawsuits by any third-party regarding the Content alleging, among other things, the infringement of copyright or trademark, or defamation or libel, or violation of any right of publicity or privacy, including any damages and reasonable attorneys’ fees or costs associated with any claim or lawsuit against BVM related to the Content.

6. Contributor grants BVM an irrevocable, royalty-free, worldwide right and permission to use, publish, display, distribute, and reproduce the Content in whole or in part, with or without alteration or modification, with or without attribution, in any format and in any or all media, versions and forms, whether now known or later invented, in all languages, in any geographic territory, in perpetuity, including without limitation all print, digital, wireless or electronic formats, and in any advertising, publicity or promotion for BVM.

7. Contributor is an independent contractor of BVM, and this Agreement will not be construed to create any association, partnership, joint venture, employee, or agency relationship between Contributor and BVM for any purpose. Contributor has no authority (and shall not hold itself out as having authority) to bind BVM and shall not make any agreements or representations on BVM’s behalf without BVMs prior written consent.

8. BVM is not required to use the Content in any manner and whether the Content is used in whole or part in any BVM publication or Website(s) is within BVM’s sole discretion.

9. This Release shall be governed by the laws of the State of Wisconsin.9. This Release shall be governed by the laws of the Province of British Columbia.

10. This Release shall be valid and enforceable when Contributor signs this Release and submits Content to BVM. BVM shall not be required to sign this Release in order for it to be valid and enforceable so long as it is signed in standard form by the Contributor.

11. This Release constitutes the entire agreement between parties regarding the subject matter contained herein.

By checking this box, I agree to submit content, copy, images, photographs, logos, and/or other media (“Content”) to Best Version Media, LLC (“BVM”) for publication in its neighborhood publication(s) at no cost to BVM. I grant BVM an irrevocable, royalty-free, worldwide right and permission to use, publish, display, distribute, and reproduce the Content in whole or in part, with or without alteration or modification, with or without attribution, in any format and in any or all media, versions and forms, whether now known or later invented, in all languages, in any geographic territory, in perpetuity, including without limitation all print, digital, wireless or electronic formats, and in any advertising, publicity or promotion for BVM. I warrant and guarantee to BVM that I own the rights to the Content, or the Content is original on my part, and is in no way a violation of, or an infringement upon, any copyright belonging to any third-party. I agree to indemnify and hold harmless BVM from any claims or lawsuits by any third-party regarding the Content alleging, among other things, the infringement of copyright or trademark, defamation or libel, or violation of any right of publicity or privacy, including any damages and reasonable attorneys’ fees or costs associated with any claim or lawsuit against BVM related to the Content. I further acknowledge and agree that BVM is not required to use the Content and whether the Content is used in whole or part by BVM is within BVM’s sole discretion and agree that BVM has the right to publish in print or post online the submitted Content without any royalty payments or further permissions.

This Content Release (“Release”) is made between Best Version Media, LLC and Best Version Media, Canada Inc. (collectively, “BVM”), and the abovementioned party (“Contributor”).
